Article 28 — Effects of Dissolution

  1. Upon dissolution of the marriage, each spouse resumes full independence of personal status.
  2. The property of the spouses shall be divided in accordance with the applicable matrimonial property regime and, where applicable, the agreement reached under Article 27(2) or the determination of the Royal Chancellery.
  3. Maintenance obligations between the former spouses are governed by Chapter 6 of this Title.
  4. Parental authority, custody, and access in respect of children of the marriage are governed by Chapter 5 of this Title and are not affected by the dissolution of the marriage, save as otherwise determined.
  5. A spouse who, upon marriage, adopted the family name of the other spouse or a combination of names may, upon dissolution, revert to the name held before the marriage by declaration to the Chancellery. The reversion shall be recorded in the civil status register.
  6. Rights and obligations arising from the marriage that, by their nature, survive dissolution, including maintenance obligations, property settlements, and obligations towards children, continue in force notwithstanding the dissolution.
